Annulment is a legal way to have your marriage declared void. Mississippi law is restrictive on the granting of annulments. Two grounds provided in law are:

  1. Bigamy (being married to a person at the time of pretended marriage to another person)
  2. Incest (being married to a person to whom you are related within the fourth degree of kinship)

In these two cases suit can be filed to have the marriage declared void, or annulled.

The other grounds for annulment must exist at the time of marriage ceremony and are:

  1. Incurable Impotency 
  2. Adjudicated mental illness or incompetence of either or both spouses
  3. Failure to comply with certain legal requirements of marriage if that failure has not been followed by cohabitation
  4. When either of the parties to a marriage is incapable, due to age or understanding, of consenting to a marriage, or is incapable from physical causes of entering into the marriage state, or where the consent of either party has been obtained by force or fraud. (These grounds exist in the absence of ratification). 
  5. Pregnancy of the wife by another man, if the husband did not know of the pregnancy. (This ground exists in the absence of ratification).

These grounds for annulment can have time limitations. Additionally the Mississippi Supreme Court has handed down decisions over the years interpreting these statutory grounds. It is essential that your attorney be knowledgeable and up-to-date on these decisions to be effective in advising you.
