Mississippi law recognizes 12 grounds for divorce based on fault:
- Natural Impotency
- Adultery
- Being sentenced to a penitentiary (and not being pardoned before being sent there)
- Willful, continued and obstinate desertion for the space of one year
- Habitual drunkenness
- Habitual and excessive use of opium, morphine, or other like drug
- Habitual cruel and inhuman treatment
- Mental illness or mental retardation at the time of marriage, if the complaining party did not know of that infirmity
- Marriage to some other person at the time of the pretended between the parties
- Pregnancy of the wife by another person at the time of the marriage, if the husband did not know of the pregnancy
- If the husband and wife are related to each other within the fourth degree of kinship
- Incurable mental illness.
All of these fault-based grounds for divorce have endured decades and decades of interpretation by the Mississippi Supreme Court. Successful divorce practice must involve a thorough understanding of these rulings and how they pertain to the facts of your particular situation. At the Law Offices of John R. Reeves, PC, we understand these rulings and maintain an up-to-date watch on all rulings of the Mississippi Supreme Court. This is essential to being able to protect and enforce your rights in your divorce. Call the Law Offices of John R. Reeves, PC, to discuss the facts of your situation before you make any move.
Mississippi law recognizes one ground for “no-fault” divorce. This ground, commonly known as “no-fault,” is legally known as Irreconcilable Differences. In order to obtain a divorce on this ground, one of two things must occur:
- The husband and wife must enter into a written agreement in which they resolve all issues touching on property, child custody and support, alimony if appropriate, payment of debts, and other marital issues. The agreement must be signed by the husband and wife.
- The husband and wife must sign a consent to divorce on the grounds of Irreconcilable Differences. The consent must set forth those matters that the parties are in agreement on and those matters that the parties submit to the court for resolution. Then the court will proceed to hear and decide those issues submitted to it
It is important to have a knowledgeable divorce attorney to represent you in the negotiation and drafting of any agreement that you make. Once you sign an agreement, you are bound by it. There are any number of legal technicalities that must be considered and that a knowledgeable divorce lawyer will look for. At the Law Offices of John R. Reeves, PC, we negotiate divorce agreements. We know what to look for. We know what to guard against. Do not try to negotiate a divorce agreement on your own. You may regret it later. Call the Law Offices of John R. Reeves, PC, now to discuss the important issues of your divorce.
