Theft is the felonious taking and removing of another’s personal property with the intent of depriving the true owner of it. Robbery is the illegal taking of the property from the person of another, or in the person’s presence, by violence or intimidation. Armed Robbery is Robbery committed by a person carrying a dangerous weapon.

If a person is convicted of Theft, Robbery or Armed Robbery, depending upon the specific crime, penalties can include long prison sentences. Fines and assessments can also be imposed. Other penalties can be imposed as well.

As soon as an act occurs which could give rise to a Theft, Robbery or Armed Robbery charge, it is critical that a trained and competent attorney be retained in order to go to the scene and take photographs, interview witnesses, gather evidence, conduct tests, and conduct other important actions, all of which could play a vital role in exonerating the accused. Early defense work cannot be underestimated.

Possible defenses against Theft, Robbery or Armed Robbery charges can include mistaken identity, insufficient evidence, the accused had a lawful right to the property and factually proving innocence. Anything you say can be used against you in court. Do not discuss the matter with anyone until you have talked with a lawyer.
